EVIAN JOURNEY OF A LIFETIME CONTEST OFFICIAL RULES

NO PURCHASE NECESSARY.

1. Eligibility: Evian Journey of a Lifetime Contest (the “Contest”) is open only to individual legal residents of Canada who are at least nineteen (19) years old, except (i) the employees, officers, directors, representatives mandataries and agents of Danone Waters of America Inc., authorized distributors of Evian® products, its and their respective advertising and promotion agencies, or any of their respective affiliates, related entities, successors or assigns; (ii) employees of any reuse or recycling depot; or (iii) persons domiciled with any of the above. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited.
2. Sponsor: Danone Waters of America Inc. (100 Hillside Avenue, White Plains NY 10603).


3. Agreement to Official RuleS: By participating in the Contest, entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.


4. Timing: The Contest begins at 12:00:00 a.m. Eastern Time ("ET"), Feb 1, 2013, and ends at 11:59:59 p.m. ET, Dec 31, 2013 (the "Promotion Period"). Sponsor’s computer is the official time keeping device for the Contest.


5. How to Enter: To participate in the Contest, visit www.source.evian.ca and follow instructions to complete the registration. Complete and submit the registration including a valid home address. P.O. Boxes are not permitted. Alternatively, participant may submit a (50) fifty word handwritten essay on the health benefits of drinking water, to Sponsor’s address shown above, to the attention of “Evian Journey of a Lifetime Contest”. Such submission must include participant’s name, address, telephone number and e-mail address, and must be received by Sponsor prior to Contest closing date. Limit: Each participant may enter no more than (1) once during the Promotion Period by any method. Limit one entry per valid e-mail address. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, all of which will be disqualified. Proof of submission or sending the Submission is not proof of receipt by Sponsor. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. Potential winners may be required to show proof of being the authorized account holder.


6. ALL POTENTIAL WINNING ENTRIES ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED, ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE AND ENTRANT HAS COMPLIED WITH THESE RULES. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE ENTRY AND IS VOID AND WILL NOT BE HONORED.


7. Prize Selection and Verification of Potential Winners: Sponsor will randomly select the potential winners, from all eligible entries received during the Promotion Period at 12:00 p.m. ET in Toronto, Ontario, on Jan 5, 2014 at Sponsor’s address. The potential winners will be notified by email or telephone, according to the contact information provided upon registration within two (2) weeks of the draw. Each potential winner will be advised of the procedure that he/she must follow to claim the prize. Each potential winner will also be required to sign and return to Sponsor, within ten (10) days of the date the notice or attempted notice is sent, a Declaration of Compliance and Release form, in order to claim his/her prize and fulfill any such other requirements as determined by Sponsor. The winners must correctly answer a mathematical skill-testing question without assistance or mechanical aid and must return the completed skill test to the Sponsor along with the Declaration of Compliance. It is strongly recommended that the potential winners photocopy all documents prior to sending and send the original documents using insured Registered Mail with a receipt of mailing. If a potential winner cannot be contacted, fails to correctly answer the mathematical skill-testing question as directed, or fails to sign and return the Declaration of Compliance and Release form within the required time periods, the potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries until the prize is awarded. Odds of winning depend on number of eligible entries received.

9. Prizes: 2 GRAND PRIZES: Each Grand Prize is a trip for two (2) to Evian Royal Resort in Evian les Bains, France. Prize package includes roundtrip, coach-class air transportation for two (2) from a major Canadian airport near winner’s home to Geneva, ground transportation from Geneva to Evian les Bains, four (4) nights' accommodations at Evian Royal Resort Hotel in Evian-les-Bains, France (single room, double occupancy) and one thousand dollars ($1,000.00) CDN. spending money (awarded in the form of a cheque). Trip must be booked at least thirty (30) days prior to departure and the trip must be completed by September 1, 2014 or trip is forfeited. Travel must be roundtrip and all travelers must travel on same itinerary. Sponsor will determine airline, flight itinerary and ground transportation in France in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel plans cannot be changed once booked. Reservations are subject to availability. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses, travel, and other costs not expressly stated in the package description above are the sole responsibility of winner, including but not limited to ground transportation in Canada, taxes, gratuities, airline baggage fees, insurance, meals, beverages, service charges, room service, telephone calls, in room movies, and incidental expenses in the hotel. If travel companion is a minor (as determined by his/her province or territory of residence), winner must be minor’s parent/legal guardian and must complete required paperwork on behalf of minor as applicable. Travel companion must execute liability/publicity releases prior to issuance of prize documents. Restrictions, conditions and limitations may apply. Winner and travel companions are responsible for ensuring that all travel papers required for travel to the applicable destination are valid, in good order, and sufficient for the trip. Lost, mutilated, or stolen tickets, vouchers or certificates will not be replaced. By accepting any ticket prize, winner agrees to abide by any terms, conditions and restrictions provided by the ticket. Sponsor is not responsible if winner does not use a ticket on the day of the applicable event. Approximate Retail Value (“ARV”): $12,000 CDN per prize. Actual value may vary based on airfare fluctuations and distance between departure and destination. Winner and travel companion must provide a valid major credit card upon hotel check-in to cover costs incurred above and beyond the standard room rate (i.e. damages). Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason subject to, in the case of Quebec, the consent of the Regie des alcohols, des course et des jeux. Limit: one (1) prize per person.


10. Publicity: Except where prohibited, participation in the Contest constitutes winner's consent for Sponsor to use winner's name, likeness, photograph, voice, opinions, biographical information, and address for promotional purposes in any and all forms of media, now known or hereafter devised, including without limitation the Internet (unless prohibited by law) worldwide, in perpetuity, without further payment or consideration.


11. General Conditions: Sponsor reserves the right to suspend, cancel or modify the Contest for any reason without notice including but not limited to, the discovery of an error of any kind in the Official Rules, fraud, technical failures or any other factor beyond Sponsor's reasonable control that impairs the integrity of the Contest, as determined by Sponsor in its sole discretion, subject, in Quebec, to the approval of the Regie des alcools, des courses et des jeux. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

14. Release: By entering this Contest, entrant agrees to release and hold harmless Danone Waters of America Inc., the authorized bottlers or distributors of Evian® products, any promotional partners, and each of their parent, subsidiary, affiliate and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Contest or resulting directly of indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Contest, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.


15. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, slow down, interruptions, or disconnections in phone networks or lines or network hardware or software connected to or related to the Contest; any problems or technical malfunction or speed or quality of any telephone network or lines, computer online systems, servers, access providers, computer equipment, or software howsoever caused; failure of any email or transmission to be received by the Sponsor, on account of technical problems or traffic congestion on the Internet or at any Website; any injury or damage to a registrant or any other person or their computer or other property, related to or resulting from participating in this Contest or website offers, or downloading any material related thereto; or, any combination thereof. Proof of sending is not proof of receipt by the Sponsor. The Released Parties are not responsible for any online or other charges you may incur in connection with participating in the Contest. The Released Parties are not responsible for the availability or content of any other website to which the website is linked. All content on the website is the property of the Sponsor or the manufacturers and suppliers of the items offered in the Contest. The Sponsor grants a limited license to each user of the website to make personal use only of the website itself. Any other use, including the reproduction, modification, distribution, transmission or display of the content on the Website is strictly prohibited; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur or arise or may have occurred in the Official Rules, in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any prize or while traveling to or from any prize-related activity. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another PIN to permit entrant to submit another entry, provided that the Contest has not been completed. In the event that it is not possible to award another entry due to discontinuance of the Contest for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the remaining prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, the Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims to select potential winners. Remaining prize(s) will be awarded to the first entrant(s) selected who correctly answer a mathematical skill-testing question and otherwise comply with these Official Rules.


16. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the Courts of Ontario, Canada; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event legal fees or disbursements; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. For Residents of Quebec Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux (the “Regie”) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.


17. Personal Information: The personal information submitted by entrants in the course of this Contest will be used solely by Sponsor and its authorized agents for the administration of this Contest and the fulfillment of the Grand Prize.
